In Cherokee County, Georgia, the Magistrate Court issues criminal arrest warrants and civil warrants. It is also possible for a citizen to file a pre-warrant in the Magistrate Court after they have reported a crime to a law enforcement agency. There are a number of requirements that must be met for the warrant to be issued. First, both the victim of the crime and the alleged offender must be over the age of 17. Alternatively, the warrant application must be filed by their parent or guardian. Also, the offense must have taken place in Cherokee County. Third, the accuser must include an incident report provided by a law enforcement agency with his or her application. Finally, he or she must provide the address of the alleged offender. Once the application has been filed, a date for a hearing will be set. If there is sufficient evidence, the Magistrate Court judge will issue the warrant. Active warrants and outstanding warrants, as well as civil warrants, are executed by the Warrant/Civil Unit of the Cherokee County sheriff's department. That unit works together with the Department of Corrections and the Cherokee County Justice Center, as well as the District Attorney, the Solicitor, and Probation offices.
